and I queried this very make,model and type of problem on the mot forums,the mot blogs and on the ministry feedback system 2 mnths before the system went live,used to own an old Passat 2000 model year,a lot of the vws of that era not only don’t have an eml but on some versions that do have it will only illuminate in the event of a fault ie no self test function when ignition switched on.the easy way to tell if this is the case is to disconnect(lets say)mass air flow,if within about 30 secs/a minute or so the eml light comes on its working fine,this has now registered a fault on the system-in short I have now damaged the vehicle and the fault now needs clearing.none of the above is permitted during a test.i specifically quoted early noughties vws as an example of this and im willing to bet theres others,i received no reply from dvsa when raising this as a concern with the regulations as worded,indeed many of the posts raising concerns such as this endemic in the new test regime/regulations were outright deleted by them.dig thru the test blogs,you never know it might still be on there,if it is they cant say they weren’t warned….
