On acceptance of this Application, www.motester.co.uk will pay the cost, on behalf of the named applicant, for MOT Consultancy Representation through the scheme known as MOT SHIELD.

MOT SHIELD will provide representation to DVSA on behalf of the Authorised Examiner and/or Nominated Tester in connection with the named entity should they receive Contemplated Disciplinary Action correspondence from DVSA in respect of activities relating to the operation of the MOT Scheme, taking place after acceptance of subscription to the MOT SHIELD scheme.

The representation will be carried out by an appropriately experienced and/or qualified individual (MOT CONSULTANT) which will give the Authorised Examiner or Nominated Tester the best chance of overturning or mitigating punitive action by DVSA.

Note: The MOT SHIELD Scheme service does not include a general helpline, training or QC, mystery shopper or other general site visits. Site visits will normally only be undertaken in cases where the MOT Consultant deems it necessary when dealing with your disciplinary case.

This MOT SHIELD representation cover agreement applies to the named AE/VTS only. The normal representation procedure will consist of:

1. Receiving from the Applicant (by post or electronic means) copies of all documents relating to the case throughout the duration of the case.
2. A verbal interview (by telephone) relating to the case.
3. An initial response from the Consultant to DVSA appealing or requesting further details or clarification.
4. Further written responses as required to bring the case to a satisfactory conclusion.
5. In the event of possible Withdrawal from the MOT Scheme notice, a site visit to the VTS may be undertaken.

Exclusions

MOT Shield will NOT cover cases where there is evidence that the AE or the AE's agent has been involved in criminal activity.

The above actions and appeals will be undertaken up to the point when the MOT Consultant considers that in his opinion the best possible outcome has been achieved and further communication or appeal would be ineffective. At this point cover under MOT SHIELD will be concluded. In the event that the claimant wishes to make further representations to DVSA against the advice of the MOT Consultant, this would not be covered under the MOT SHIELD cover, and would be at extra cost, to be negotiated directly with the Consultant.

Acceptance

If your application is accepted by www.motester.co.uk, representation under MOT SHIELD will be active for the period of cover, which will be clearly stated on the acceptance document. Disciplinary matters raised by DVSA which originate before cover commences are not covered by the MOT SHIELD Scheme.

On acceptance of this Application by www.motester.co.uk, the named Applicant will be notified in writing and will be given a Membership Number and full details of how to claim for MOT Consultancy representation under the MOT SHIELD scheme.

At that stage the commercial relationship will be between the nominated MOT Consultant and the Applicant, and the Applicant agrees to abide by the judgment and decisions made by the MOT Consultant, including the assessment of the point in the representation process at which further action would not be productive.

Under the MOT Shield plan, www.motester.co.uk undertakes to indemnify the Applicant against all MOT Consultancy representation costs provided under the MOT SHIELD Scheme. In turn, the Applicant agrees that all claims and costs which may arise as a result of the advice given by the MOT Consultant, or actions advised by the MOT Consultant, will be directed solely against the MOT Consultant and not against www.motester.co.uk.

Should this Application not be accepted, any fee received in respect of applying for the MOT SHIELD Scheme shall be refunded in full.

Note: If any of the details supplied change during the term of membership, MOT SHIELD must be notified immediately, or this Agreement becomes invalid.
